Judge rules Texas ban on same-sex marriage unconstitutional

SAN ANTONIO -- A federal judge in Texas ruled Wednesday that the ban on same-sex marriage is unconstitutional.  However, he will not require the state to enforce the law. Instead, an appeal is expected to be filed with the U.S. Court of Appeals, and will likely go the U.S. Supreme Court.

The ruling came from U.S. District Court Judge Orlando Garcia in San Antonio. He ruled that the state’s marriage laws discriminate against gay couples for no legitimate reason.
