Smoke Shop Seeks Permission to Sell Alcohol Less Than 300 Ft. from Bozeman Elementary

LUBBOCK, TX -- The Lubbock City Council will decide Thursday if Tobacco Road, 2908 Parkway Drive, can have a variance to sell alcohol less than 300 feet from Bozeman Elementary School, which was consolidated about two years ago and is no longer used for classrooms.  The location is also less than 300 feet from a local daycare according to records from the City of Lubbock.  Public records indicate the variance, if approved, would allow for beer and wine sales. 

The President of Tobacco Road, Anthony Carter, 47, of Lubbock, wrote the request for an alcohol variance on June 27.  Carter was charged earlier this month with a violation of the state’s deceptive trade act.  Specifically, he was accused of allowing the sale of synthetic marijuana in his smoke shops.  He was arrested, posted bond and then released from the Lubbock County Detention Center on July 9.
