Man Accused of Striking Down Cyclist Receives 10 Years Probation

A former Texas Tech student avoids a jail sentence after he hit and killed a Lubbock bicyclist while driving drunk.

Thursday 24-year-old Benito Capellan received ten years probation from a Lubbock judge.

Earlier Thursday a Lubbock jury recommended the ten-year probated sentence for Capellan.

Defense attorneys told jurors that Capellan will spend the rest of his life working to honor the life of Britta Schneider, the 32-year-old he struck and killed.

                They say Capellan will teach college students about the dangers of drunk driving.

                Prosecutors argued for a heftier sentence that included jail time.
