David Wayne Bethel, 41, accused of murder, filed a federal civil rights lawsuit against Lubbock County on Tuesday.
Bethel’s lawsuit said, “I write to ask for injunctive relief. My diagnosis is congestive heart failure. I have previously had two strokes. I am having grave medical problems, and medical here in Lubbock County Detention Center is avoiding treatment. Please help.”
The entire lawsuit was contained on a single handwritten page.
Previous court documents in State District Court said Bethel conspired with his cousin, Mark Bethel, to murder Shawn Summers in October of 2015. Court records said Summers may have had an intimate relationship with Mark Bethel’s girlfriend, Jessica Payton.
Summers and Payton were found dead in separate locations in Lubbock County.
Mark Bethel was charged with both murders — Payton and Summers. David Bethel was only charged in Summers’ death.
David Bethel remained in the Lubbock County Detention Center on a $400,000 bond. The murder charge was still pending.
